INTRODUCTION
This document (together with all other documents mentioned below) sets out the terms and conditions for the use of the website and the purchase of products through this website (hereinafter referred to as the "Terms of Use").

The Seller shall hereinafter be referred to as "Kolektif Life" for the purposes of this Contract.
Buyer refers to the natural and/or legal person who reads this information and subsequently places the order and/or completes the payment by filling in the relevant forms.
OUR INFORMATION
All services provided in the Seller's store and the web pages on our site and all pages connected to it ('site') are the property of the Seller (Firm) Blue Way Holding Ltd. (Kolektif Life Trading) registered at Karaoğlanoğlu Caddesi, No.323, Edremit, Kyrenia, Northern Cyprus and are operated by the Seller.
Sales of goods made through this website are carried out under the name Kolektif Life Trading.
GENERAL TERMS OF USE
Our Buyers who use and shop on this shopping site are deemed to have accepted the following terms:
By using all the services offered on the site, you ('Buyer') are subject to the terms as below and by using and continuing to use the service on the site; You are deemed to have accepted that you have the right, authority and legal capacity to sign a contract according to the laws you are subject to and that you are over the age of 18, that you have read and understood this contract and that you are bound by the terms written in the contract.
This contract imposes rights and obligations on the parties regarding the site subject to the contract, and when the parties agree to this contract, they declare that they will fulfill the aforementioned rights and obligations completely, correctly, on time and within the conditions requested in this contract.
Kolektif Life reserves the right to make changes regarding Return and Exchange Terms. In case of changes to the Return and Exchange Terms, the Return and Exchange Terms contract as amended will be applied.
RESPONSIBILITIES
The Seller always reserves the right to make changes to prices and the products and services offered. The Seller agrees and undertakes that the Buyer shall benefit from the services subject to the contract, except for technical failures, only if the Buyer fully fulfills the obligations undertaken to be fulfilled by the Buyer in the contract.The Buyer agrees that it will not reverse engineer the use of the site or take any other action intended to find or obtain the source code thereof. It accepts in advance that it will be responsible for the damages arising before the persons and that legal and criminal proceedings will be taken against it. The Buyer accepts that it will not produce or share content that is against general ethics and morality, against the law, violates the rights of 3rd parties, is misleading, offensive, obscene, pornographic, violates personal rights, violates copyrights, or encourages illegal activities in its activities on the site, in any section of the site or its communications, contrary to general morality and decency or contrary to the law. Otherwise, it is fully responsible for the damages that may occur, and in this case, the 'Site' authorities reserve the right to suspend or terminate such accounts and initiate legal proceedings. For this reason, it reserves the right to share information requests regarding events or user accounts if requested by judicial authorities.
INTELLECTUAL PROPERTY RIGHTS
All registered or unregistered intellectual property rights such as title, business name, trademark, patent, logo, design, information and method on this Site belong to the site operator and owner company or the specified relevant person and are under the protection of the legal legislation applied in the TRNC, Turkish law and international law. In the event of a violation of this article by the Buyer, the Seller reserves the right to take all legal action in this regard.
PRIVACY AND SECURITY POLICY
Some personal information (such as name-surname, company information, telephone, address, or e-mail address) of the members is collected by the Seller due to the nature of the business by filling out various forms and surveys on the membership or the Seller's Store. The Seller shall not disclose the personal information provided by the users through the site to 3rd parties except for the conditions in the provisions of Article "3.3.3." and Article "3.3.8" below. This personal information includes all kinds of other information to identify the Buyer, such as the person's name-surname, address, telephone number, mobile phone, and e-mail address, which will be briefly referred to as 'Confidential Information'.Confidential Information may only be disclosed to the official authorities if such information is duly requested by the official authorities in accordance with the procedure and in cases where disclosure to official authorities is mandatory in accordance with the provisions of the mandatory legislation in force.
The Buyer accepts and declares that it consents to the company that owns the Site sharing its contact, portfolio status and demographic information with its affiliates or group companies to which it is affiliated, limited to its use only within the scope of marketing activities such as introduction, advertisement, campaign, promotion, announcement, etc. This personal information may be used to determine the Buyer profile within the company, to offer promotions and campaigns by the Buyer profile and to conduct statistical studies. The Seller may send campaign information, information about new products, and promotional offers to its customers and members during certain periods. The Buyer can make any choice as to whether or not to receive such information while becoming a member, and then change this choice in the account information section after logging in as a member, or make a notification via the link in the notification message received.
During the approval process carried out through the Seller or by e-mail, the personal information transmitted to our store electronically by the Buyer may also be used for the purposes and scopes determined by the "Distance Sales Contract" made by the Seller with the Buyer.To identify system-related problems and to quickly resolve any problems or disputes that may arise regarding the service provided, the Seller records and uses the IP address of the Buyers. IP addresses may also be used to identify Buyers in a general way and to collect comprehensive demographic information.
The Seller may use the requested information for direct marketing purposes by itself or its collaborators outside the purposes and scope specified in the Membership Agreement. Personal information may also be used by the Seller to contact the Buyer if necessary. The information requested by the Seller, or the information provided by the Buyer, or information regarding transactions made through the Seller Store may be used in various statistical evaluations, database creation and market research.
The Seller undertakes to keep confidential information strictly private and confidential, to regard it as a confidentiality obligation and to take all necessary measures and to exercise due diligence to ensure and maintain confidentiality, to prevent all or any part of the confidential information from entering the public domain or from being used unauthorized or disclosed to a third party; provided that such information is duly requested by official authorities by the procedure and disclosure to official authorities is mandatory in accordance with the provisions of the mandatory legislation in force.
NO GUARANTEE
This contractual clause shall be valid to the maximum extent permitted by applicable law. The services provided by the Company are provided on an "as is" and "as available" basis and no warranties of any kind, express or implied, statutory or otherwise, are made concerning the services or the application (including all information contained therein), including all implied warranties of merchantability, fitness for a particular purpose or non-infringement. The responsibility for the electronic products purchased and/or provided through the Seller in this Contract belongs to the Manufacturer Company.
REGISTRATION AND SECURITY
The recipient must provide accurate, complete and up-to-date registration information. Otherwise, this Contract ("Distance Sales Contract") will be deemed to have been violated and the account may be closed without informing the User.The Buyer is responsible for password and account security on the Seller and third-party sites. Otherwise, the Seller cannot be held responsible for data loss and security breaches or damage to hardware and devices.
FORCE MAJEURE
If the parties cannot fulfill the obligations arising from the contract due to reasons beyond the control of the parties; such as natural disasters, fire, explosions, civil wars, wars, riots, epidemics, civil movements, declaration of mobilization, strikes, lockouts and epidemics, infrastructure and internet failures, power outages (hereinafter collectively referred to as "Force Majeure"), the parties are not responsible for this until the force majeure is eliminated.If the sale of the purchased product becomes impossible except for the force majeure reasons mentioned above and again except for the reasons of supply and/or stock shortages caused by the manufacturer, the Seller must notify the Buyer in writing within 3 days from the moment the Seller learns of this situation. The total price must be returned to the Buyer within 14 days.
INTEGRITY AND APPLICABILITY OF THE CONTRACT
If one of the terms of this contract becomes partially or completely invalid, the remainder of the contract shall remain valid, unless the Buyer has violated the obligations it has undertaken to fulfill in the contract.
CHANGES TO BE MADE IN THE CONTRACT
The Seller may change the services offered on the site and the terms of this contract partially or completely at any time. The changes will be effective from the date they are published on the site. It is the Buyer's responsibility to keep track of the changes. The Buyer is deemed to have accepted these changes by continuing to benefit from the services offered.
NOTICE
All notifications to be sent to the parties regarding this Contract will be made to the seller known e-mail address and/or WhatsApp number and/or the e-mail address and/or WhatsApp number specified by the Buyer/User in the membership form. The Buyer accepts that the address specified when becoming a member is the valid notification address, that it will notify the other party in writing within 5 days in case of any change, and otherwise the notifications made to this address will be deemed valid.
EVIDENTIAL CONTRACT
In any disputes that may arise between the parties for transactions regarding this contract, electronic mail, social media correspondence, books, records and documents, computer records and fax records kept by the company will be accepted as evidence and/or testimony under the Chapter 9 Testimony Law and in any disputes that may arise for transactions regarding this contract, the 9/76 Courts Law, Chapter 9 Testimony Law and Chapter 149 Contracts Law and Turkish Republic and international law deposits will be applied and accepted as evidence in accordance with the Civil Procedure Law No. 6100, and the Buyer and/or User agrees not to object to these records.
RESOLUTION OF DISPUTES
The TRNC Courts shall be authorized to resolve any disputes arising from the application or interpretation of this Contract.
APPLICABLE LEGAL LEGISLATION
Regarding the sale and delivery of the product they purchase, the Buyers are subject to the provisions of the Consumer Protection Law No. 40/2003 and Chapter 149 Contracts Law as well as other applicable laws and regulations as set out in Article 3.10 above.
NON-PAYMENT OF THE PRODUCT PURCHASED
If the Buyer fails to pay the price of the product purchased or cancels it in the bank records, the Seller's obligation to deliver the product ends.
BUYER'S OBLIGATION TO INSPECT THE PRODUCT
The Buyer shall inspect the goods/services subject to the contract before receiving them; damaged and defective goods/services, such as crushed, broken, torn packaging, etc. will not be received from the cargo company. The goods/services received shall be deemed to be undamaged and intact. The Buyer must protect the goods/service carefully after delivery. If the right of withdrawal is to be exercised, the goods/services must not be used and/or the packaging must not be opened in the case of packaged products.
The Invoice must also be returned along with the product.The Buyer must open the received package in the presence of the cargo officer and check its order. The product that the Buyer opens and checks in the presence of the cargo officer is deemed to have been delivered without any problems. The Seller is not responsible for any problems and/or damage to the product during shipping.
RETURN AND EXCHANGE TERMS
Kolektif Life prioritizes protecting consumer rights; all kinds of product and service-related problems you may experience during all purchases you make from the Kolektif Life official site are meticulously evaluated and resolved at the soonest possible time. For this reason, our post-delivery survey and/or your comments are important to us so that we can serve you better.In case of shopping, these Return and Exchange Terms will be deemed to be accepted and/or approved.In the continuation of this article, the Customer and/or the shopper shall be referred to as the "Buyer" and Kolektif Life shall be referred to as the "Seller".
Kolektif Life reserves the right to make changes regarding the Return and Exchange Terms, and in the event of changes to the Return and Exchange Terms, the modified return and exchange terms will apply. In case the protective elements such as packaging, tape, seal, and package are opened after the delivery of the goods, the right to change the product and the right to withdraw and/or cancel the purchase (return) regarding food, bread, jam and other food products offered in the material environment are excluded from the scope. Return of any product whose packaging has been opened and/or used will not be accepted. Similarly, books whose packaging is opened and/or the plastic packaging is torn after the delivery of the goods are also excluded from the scope of return.
The Buyer acknowledges that the warranty and maintenance and/or service policies of the small household appliances (SMEG and BOSCH brands) purchased by the Buyer may differ between the companies. The Buyer acknowledges that coverage of warranty, maintenance and service policies valid for small household appliances is the responsibility of the main supplier company.
The Seller shall not be liable for any malfunction and/or damage and/or defective and/or faulty goods arising from the supplier company. The Buyer accepts that it there is no right such as returning the white goods purchased after the installation is completed. For products which are not covered by the provisions of Articles 4.5 and 4.6 above, the following conditions shall apply:
Return Period (Right of Withdrawal and/or Cancellation)
In distance contracts for the sale of goods, the Buyer has the right to withdraw from the contract and/or cancel the contract by rejecting the purchased goods and/or shopping products and/or goods purchased without any legal and criminal liability within three days from the date of receipt if the goods are defective and/or faulty and/or the packaging is not damaged and/or unwashed and/or unused and/or unwashed (Except for small household appliances specified in article 4.6 above through the supplier company). In distance contracts regarding the provision of services, this period begins on the date the contract is signed.
The Buyer and/or consumer may exercise the right of withdrawal and/or cancellation if the performance of the service is agreed in the contract to be made before the expiration of one week and the goods and/or products subject to a sale are not shipped. If the product has been shipped, the Buyer and/or consumer shall be deemed to have lost the right to cancel and/or withdraw as of the notification to the Buyer the product has been shipped.
If the Buyer and/or the consumer have fulfilled their obligations under this paragraph, the Seller shall be responsible for the costs incurred.In order to exercise the right of withdrawal, the Buyer must notify the Seller via the phone number and/or e-mail specified above within the three-day period and, the goods/services must be in compliance within the framework of the provisions of the Distance Sales Contract and by the information that is an integral part of this Contract, the packaging and content of the goods/ services must not be damaged, and the Seller must be able to offer them for resale and that the product must not have been shipped.The return procedures within the scope of the Right of Withdrawal and/or Cancellation are included in the Distance Sales Contract.
In the event of this right being exercised, the return of the original invoice of the goods/services delivered to the 3rd party or the Buyer is mandatory.The price of the goods/service and delivery costs shall be returned to the Buyer within 30 (thirty) days at the latest following the receipt of the notice of the right of withdrawal and/or cancellation, and the Buyer is obliged to return the goods/service within 10 (ten) days. If the original invoice is not sent, no refund and/or payment and/or exchange will be possible.If the value of the goods decreases or the return becomes impossible due to the fault of the Buyer, the Buyer is obliged to indemnify the Seller. Payments for refunds can be made either by credit card, EFT or wire transfer.
Products for which the Right of Withdrawal and/or Cancellation Cannot be Used
Goods/services that cannot be returned due to their nature are goods/services that deteriorate rapidly and expire, disposable goods/services, and all kinds of software and programs that can be copied. In addition, to exercise the right of withdrawal and/or cancellation of all kinds of packaged products, the packaging of the goods/services must be unopened and/or damaged and/or intact and unused.Products for which the right of withdrawal and/or cancellation cannot be exercised in this contract, Goods or services whose price is subject to fluctuations in financial markets and is not under the control of the seller or provider.
Goods that are tailored in line with the consumer's wishes or personal needs,Disposable goods, Goods whose protective elements such as packing, tape, seal, and package have been opened after delivery and products whose return is not suitable for health and hygiene, Goods that get mixed with other products after delivery and cannot be separated due to their nature,Products whose protective elements such as packing, tape, seal, and package have been opened and/or damaged after delivery, Products that can be sold on a specific date or period (New Year’s Day, Mother's and/or Father's Day, etc.),Services that have started to be performed with the consumer’s approval before the expiration of the right of the withdrawal period.
The right of withdrawal and/or cancellation and/or return cannot be used for the products and/or goods and/or services specified in all the above articles.
RETURN PROCEDURE
Before sending the product to Kolektif Life, you must inform us of your request to return by filling out the product return form on this page. After our technical department sends you the approval for the shipping of your return, please fill out the return form that comes with the package and send the product to us with a cargo company you trust. You will be notified with the approval information by phone or e-mail.
The cost of shipments made by cargo companies belongs to the sender. Counter-paid shipments will not be accepted. In the event that the products we receive are delivered in accordance with the return conditions, the refund of the product will be processed on the day the product is received at our end. In order for the request for product return to be acceptable, the originality, hygiene and resalability of the Product must be preserved. Therefore, we cannot accept the return of products with damaged packaging, products that are used, destroyed, or whose packaging has been opened, and in other similar conditions.
In the event of a return of the product, we kindly ask you to inform us of the reason for returning the product.It is entirely up to Kolektif Life to apply and/or not apply the return procedure even in cases where the reasons to return are stated, and acceptances and/or approvals made once do not imply that they will be made again.The products to be returned must be delivered complete and undamaged including the box, packaging, and standard accessories, if any together with the return form.

SHIPPING, EXCHANGE AND RETURN PROCEDURE
The products to be returned must be delivered complete and undamaged including the box, packaging, and standard accessories, if any together with the return form. If the invoice of the product that the Buyer wants to return is in the name of the Seller, it must be sent together with the return invoice issued by the Seller when returning it. The return invoice must be issued without including the shipping cost (product price + VAT).Products purchased from the site are under the guarantee of the manufacturing company. The invoice to be sent by the seller along with the purchased product substitutes the certificate of guarantee. For this reason, please keep this invoice sent by the Seller carefully.In exchange and return transactions, the fees for the cargo sent by the Buyer to the Seller are paid by the Buyer.
The fees for the shipments made after the exchange transaction are covered by the Seller.The Buyer may return the product within 15 (fifteen) days from the date of delivery without unpacking, damaging, destroying, spoiling, or using the product, provided that the Buyer has notified the Seller in writing within 3 days after receiving the product. The Buyer, in this case, must deliver the product, the invoice of the product and the return petition to the Seller.
In order for the request of product return to be acceptable, the originality, hygiene and reliability of the Product must be preserved. The products excluded from the right of return, exchange and withdrawal are also valid in terms of these articles.
The product to be returned by the Buyer must not have lost its commercial qualities. After the Seller confirms that there is no obstacle to the return of the product, the product price will be refunded to the Buyer's credit card or bank account within 4 weeks.
The shipping services during this transaction are the responsibility of the Buyer. Returns of unpackaged, damaged or used products are not accepted. You can send your questions about the subject to hello@kolektif.life.As a ground rule, the Buyer may return the product within 15 days from the date of delivery.
The Buyer, in any case, has read and accepted the articles regarding the products that can be returned and exchanged in this contract. The Buyer must open and check the packages that he/she thinks have been damaged during shipment in front of the cargo officer from whom he/she receives them. In case of any damage to the product, the Buyer has the right not to accept the product by having a report to be kept by the cargo company. The Buyer will be deemed to have accepted that the cargo company has fully fulfilled its duty after receiving the product. The Seller is not responsible for any problems and/or damage to the product during shipping.
GENERAL RETURN CONDITIONS
The return of the products subject to the contract must be made with the original box or packaging.The return of products whose original box/packaging has been damaged (for instance; products with a cargo label attached to the original box and taped with cargo duct tape are not accepted), as they have lost their resalability and cannot be purchased by another buyer.
The Buyer is obliged to return the product in the condition in which it was delivered to him/her and, if the product is used, the Buyer is then obliged to compensate for the loss of commercial value of the goods due to use.The Buyer must send the original invoice (all copies in the Buyer's possession) and a petition expressing the reason for the return together with the product he/she wishes to return.If the product/products that the Buyer wants to return are defective, the shipping fee is covered by the seller company.
REFUND POLICY AND REFUND PROCEDURES
The incoming product is first examined by the Returns Department. The return process is initiated if it complies with the conditions specified in the above articles, "Shipping, Exchange and Return Procedure, General Return Conditions, Return Procedure and Return and Exchange Conditions". The duration of this transaction varies between 3-7 working days.The fee will be refunded to the Buyer's credit card within 21 working days at the latest after the product reaches the Seller in full with all copies of the invoice. It takes between 1-6 weeks for this refund to be reflected on the Buyer's credit card by the Buyer's bank.
The Buyer must open the received package in the presence of the cargo officer and check its order. The product that the Buyer opens and checks in the presence of the cargo officer is deemed to be delivered without any problems.
REFUND POLICY AND CANCELLATION PROCEDURES
The Buyer may cancel the order by informing the e-mail address hello@kolektif.life, provided that he/she has not been notified that the product has been shipped on Monday-Friday between 08.00 - 17.00.If the invoice of the product that the Buyer wants to return is in the name of the seller, it must be sent together with the return invoice issued by the Seller when returning it. The return invoice must be issued without including the shipping fee (product unit price + VAT).
DELIVERY INFORMATION
The transportation and delivery conditions may vary from time to time due to the different characteristics of the products offered in the categories on our site. You may find up-to-date information at the site kolektif.shop.
PAYMENT METHODS
The cash on delivery option is not available. Payments can be made by credit or debit card. Alternatively, you can make your payment by Bank Transfer or EFT (Electronic Funds Transfer), deposit to .......................................IBAN. On our site, you can make online payments with your credit cards in a single payment or installments to all your credit cards. In your online payments, the amount will be deducted from your credit card at the end of your order.If the payment is to be made in a currency other than Turkish Lira, the amount to be paid is calculated at the exchange rate of the day.
SHIPPING METHODS
Delivery from Kolektif Life Pick-Up Points - FREE.You will receive a notification email when your order is ready for pickup. When you come to pick up your order or someone else comes to pick it up for you, the order information is requested for verification. Shipping to Address (Cargo): Our general delivery time is 1-3 working days. However, it may vary depending on the delivery address and product availability. Delivery is provided during working hours and the delivery time covers the preparation of the order as well. We do not deliver on Sundays and special holidays.
